Whether your car is a daily driver, a custom car or a junker, there are several documents you’ll need to legally sell your used car privately:
  • Vehicle History Report
  • Maintenance records
  • Transferable warranty (if applicable)
  • As-Is documentation
  • Odometer disclosure
  • Vehicle title
  • Bill of Sale

First order of business is to make sure payment for the car has been secured before signing over the title, ownership or any other documentation. Check with your state’s Department of Motor Vehicles for the required documentation and process to transfer ownership of a car. You may also want to check with the county the car is currently registered and the state or county where the car is to be registered. Some states laws leave procedure interpretation to the individual county. If there is still a lien on the car title, meaning you don’t own the car outright, you’ll need to contact the lien-holder (usually a bank but can be a repair shop or private party) to find out how much is still owed on the car and what steps are required in transferring the title. If you have a clear title in hand, you can sell the car and transfer the title to the new owner. Best practice is to meet at your bank to finalize the transaction. You can sell a car without a title but may be required to obtain a replacement or duplicate title. Prior to selling the vehicle contact your state’s Department of Motor Vehicles with questions about how to sell a car that does not have a title.
